Whether a loved one in Jamaica, Flushing, Astoria, or Rockaway has lost capacity to manage their affairs — or a minor needs a court-appointed guardian — the path begins with the right petition in the right Queens court. Morgan Legal Group guides Queens families through every track.
Which Court Handles Your Case?
The court depends entirely on the type of guardianship you need:
| Situation | Governing Law | Court in Queens |
|---|---|---|
| Adult who can no longer manage personal or financial needs | MHL Article 81 | Supreme Court, Queens County |
| Minor’s person or property | SCPA Article 17 | Queens County Surrogate’s Court |
| Developmentally/intellectually disabled person (often turning 18) | SCPA Article 17-A | Queens County Surrogate’s Court |
How an Article 81 Appointment Proceeds
Adult guardianship under MHL Article 81 is commenced by an Order to Show Cause and Verified Petition filed in Supreme Court, Queens County. The court appoints a Court Evaluator to investigate and report. Incapacity must be proven by clear and convincing evidence — that the person cannot manage property or personal needs and faces likely harm as a result.
Powers granted must be the least restrictive intervention necessary. Once appointed, a guardian files an initial report within 90 days, annual reports thereafter, and must visit the incapacitated person at least four times per year. See guardian duties for a full breakdown.
Before Filing: Explore Alternatives
Queens courts expect petitioners to consider alternatives to guardianship first: a Durable Power of Attorney under GOL §5-1513, Health Care Proxy, Living Trust, or Supported Decision-Making agreement can sometimes achieve the same protective goals without a court proceeding.
